Tighten cosmetics business on e-commerce platforms

The Ministry of Health has proposed focusing on inspecting cosmetics trading activities on e-commerce trading floors and social networking platforms.

On the other hand, the Ministry of Health has recorded that the websites of enterprises, e-commerce trading floors and social networking platforms selling cosmetics are hand-carried, counterfeit, of unknown origin or unlicensed. There are even signs of consuming smuggled cosmetics and tax evasion; advertising cosmetics that are not consistent with their nature and are misleading as drugs.

At the same time, the media discovered some cosmetic advertisements that were inconsistent with the nature of the product, product classification, and features and uses in the declaration file that had been granted a cosmetic product declaration receipt number. The advertised cosmetics caused misunderstandings that the product was a medicine; the content of cosmetic advertisements used images, costumes, names, letters, and articles of medical units, facilities, doctors, pharmacists, and medical staff.

The Drug Administration of Vietnam informed the local health departments to continue to strengthen inspection and examination of the implementation of legal regulations on cosmetics management for cosmetics manufacturing and trading enterprises in the area… At the same time, regularly and proactively coordinate with the local Steering Committee 389, the Market Management Department and related functional sectors to strengthen inspection and examination of cosmetics circulating on the market.

“In particular, focus on checking cosmetic business activities on e-commerce trading floors and social networking platforms TikTok, Zalo, Facebook, YouTube… to promptly detect and handle illegal cosmetic production and trading activities, suspected counterfeit cosmetics, cosmetics in circulation that have not been granted a declaration receipt number, cosmetics of unknown origin; advertising cosmetics with features and uses that exceed the inherent features and nature of the product, inconsistent with the announced features and uses of the product or causing misunderstanding that the product is a drug”, the official dispatch of the Department of Drug Administration stated.

Organizations and individuals who violate the regulations on production and trading of cosmetics must be strictly handled and punished according to regulations; All suspected counterfeit cosmetics, cosmetics of unknown origin, poor quality, and unsafe for consumers must be recalled and destroyed; The case must be transferred to the investigation agency for criminal handling according to regulations if there are signs of crime.

According to the request of the Ministry of Health, organizations and individuals are not allowed to produce or process cosmetics at domestic cosmetic production facilities that have not been granted a certificate of eligibility for cosmetic production; they are only allowed to put cosmetics into circulation when they have been granted a cosmetic product declaration receipt number by a competent state management agency and must take full responsibility for the safety, quality and effectiveness of the product.
